Well I tend to be on the hawkish side with these guys but
1) There is here, as in real life, a presumption of innocence. Sometimes I say to myself "this guy is just looking for hits on his youtube channel" but you've got to let that become clear before you can do anything about it (and sometimes I'm wrong).
2) A soft word turneth away much wrath. Where possible moderators deal with things behind the scenes via PM - which is good because there's less chance of a loss of face. You don't necessarily see the moderatorial process in action.
3) We can't read every new post on the forum. So you can always report cases where you think this is happening. Using the "report to moderator" function also keeps things quiet and private and, again, avoids public loss of face and thus potential public displays of defiance.
