1) The implicit trust when someone becomes a custodian of our property

anyway i also deal with marshall music woodmead almost exclusively and had no issues with them..... and they always great order anything i want an beat most everybody's prices.......... so i'm happy with the marshall music in woodmead ....... but yeah sh*t happens i guess....
and just a note marshall music in woodmead now has jochim who runs his own company JD custom on marshall music premises in woodmead for repairs....... i have had guitars in and out of his workshop and it's prompt turnaround times and good work......... so maybe the other branch's still outsource repairs... but at marshall music woodwood it's all done on the property ....... so i guess that allows one to feel more comfortable.......... as far as i know andy mc gibbons and music connection also have instore workshops........
my only question would be why let this go on for 2.5 years .. i would be on their doorstep if it took longer than 7 days ......

I think Marshal at the Glen acuired the bad rap from the old owner, Marshal used to be at Comaro Crossing on the top floor. but the thing that gets me is, Why did you wait two and a half years to find out what is happening with you guitar. surly you would have asked questions as what is happening to it within the first week. Don't make sense ☹

random comment, I went to marshall in the glen a few weeks back, and asked them if they had a tu2? and I got given a blank look and a "huh" then i specified Tuner!!!! and i got a "yah bru" and was handed a peice of crap little quick tune...... May i say i would never return to them.

The customer was in love with the instrument.
How can you tell a customer that his precious instrument sucks, are you stupid? You could just tell the customer you are so sorry and give him a decent 12 string and try make it up. What are you losing? You can claim business insurance on the loss. What a fool.

Wait ... when they accepted your gran, didn't they implicitly commit to look after her?

Guitars, for all that we like them, are not human beings. There is a distinction in law, and should be in most areas of activity, between human beings and inanimate objects.

I think it sucks that this has happened and they are responsible for the loss of your instrument. They lost your guitar in their negligence, so they should replace it with something that is of similar value OR similar specs, which ever is more appropriate.
Do you still have all the documentation that they gave you, or should have gave you, when you handed the guitar in? All the best.

I would take up one of their options, buy a new guitar at cost.
eg a R30,000 Taylor 12 string for purchase price to you of R10,000.
Sell it to a willing buyer (eg Bob) for R20,000, you make R10,000, he saves R10,000.
Everyone is happy, even the music store.
Sentimental value? I couldn't work up any attachment to a guitar. Sorry.

sorry i been awol.. just been busy at work.. lotsa mixed reactions i see... gud to hear feedback never the less..
just another answer to some of the questions, for as to why i waited for 2,5yrs, the first year, i called them every month, over and above the 3 weeks they said it will take to get fixed.. then after that every second month and so on and so forth, as i use to stay in the south, i regularly visited the stores for updates.. i got the same response as i did the first time i called, "we cant get a hold of the repairman, we will call u when we have more information"... only when the store, went under new management, did i actually get a call back which was last yr sometime.. and i had to call again 2 weeks ago, and i got a prompt response, so cu-dos to the new mngt there..
i was fairly reasonable and i gave them more enough time to exhaust what ever resources they had, with out being unreasonable or making it an issue..untill last week when i was asked to replace my own guitar on their account... this is where it becomes a prob, i entrusted them repair the guitar as they claim to do so as part of their service offering.. needless imho to say poor service never the less..
just an update, its gna cost me like R1,2k for a lawyer consult and to draft a letter before legal action and then another 6k and a bit to fight the issue.. to which i have to give an estimation on the value of the guitar, which is still problematic to quantify let alone hold it in court..
given what i know now, its rather unfeasible to push this legally, i am still weighing up options, is it really worth all this admin to go on principle and make a point for customer service in general, that being said, Marshal in the south has definitely lost me as customer, i bought quite a bit of stuff from the marshall in woodmead as well n i never had issues there.. but after chatting to Dwayne Marshall, personally i wont support them at all, either store, i think that bridge has been burnt..
ukno i could suck it up and pay 1k for a new guitar, i just feel it sets the president for how dispensable we are as customers..and almost condoning what they have done and sayings its ok...
i honestly have no idea what to do now.. any ideas???

Tyrone, I have read all you have said and all the "advice/replies" etc from the good people on this forum........
What would I do? ..... quite honestly, I would write it off, and move on instead of prolonging the anger and frustration.......in the end, (and I say this very cautiously)...... it is a material object. I always try to look at what could have been worse.........more important things........one's sanity is ... ..........hope I make sense.
