just from a legal aspect , i dont think such a thing as a non refundable deposit is actually legal ...no matter how many times its mentioned.

but then i could be wrong on this.

This is why I will not post my number on Gumtree when I post an add. Because people phone you and want to get a lower price. I don't have time to have those phone calls. I can deal with the e-mails, because after awhile I can just stop replying if they get ridiculous. Only when someone is serious do I give them my number!

Uhm, then what is a deposit? I would have thought that you shouldn't even have to mention that it is non-refundable, the word "deposit" implies that it is non-refundable.

Depends on the law of the land , generally deposit implies it is refundable .(if not stated it would be viewed as refundable)

Our law in ZA generally implies a deposit is refundable ie lease agreements and the like, laybays are refundable if the client changes his mind for instance but the vendor is entitled to subtract a "fair" charge.

Under what conditions did he pay the deposit? I believe the consumer protection act (CPA) affords the supplier (you) the right to a reasonable deposit / cancellation fee relating to the sale of a product, but I suppose it would depend on the circumstances.

Please give me your banking details and I'll EFT you the money, I don't want you anywhere near my house, set a foot on my property and I'll call the cops, (they are 2 blocks away).

I decided screw it, I have a wife, two young daughters and while this guy isn't really that intimidating, it's always these wack jobs that pack heat and seriously, I don't want to get capped over R300.

Just for the record, he paid the deposit in front of me, my wife and his buddy and he was told 5 (FIVE) times that this is non refundable and if he changes his mind or backs out, the money is mine. He even made a huge joke out of it saying that he usually carries 5-10k in cash around at all times and I've caught him on a light day.

For all I know, the dudes a freaking dealer...........

+1. I think this is the smart route. Annoying yes, but not worth literally risking life and limb over (sadly that's what it comes to sometimes). You'll recover that money easily enough.

Yeah, the only problem is that you have now robbed us of a potentially entertaining thread. We have all just settled in and gotten ourselves ready for the show and now there will be none. How do you repay that deposit?
